The Kingdom of Saudi Arabia has adopted the Gulf Cooperation Trademark Law (GCC Trademark Law) to protect intellectual properties, specifically trademarks of businesses. This law specifies a set of conditions for prosecuting and enforcing trademark rights. The GCC Trademark Law is uniformly implemented in GCC countries, namely, Bahrain, Kuwait, Oman, Qatar, KSA, and UAE. This law does not have a unitary registration system. Each nation accepts its registrations at its trademark Office. Saudi Authority of Intellectual Property (SAIP) is the office that handles Trademark registration in KSA. Thus, it is to this office that we have to apply for the registration of a trademark in Saudi Arabia. SAIP strengthens the IP infrastructure of KSA by fostering IP awareness, implementing trademark regulations, and coordinating enforcement efforts.
Infringement, opposition filings, and ownership conflicts may result in trademark disputes in KSA. To enforce trademark rights, companies can file a complaint at the MOC or Commercial Courts. Companies need to submit evidence of infringement along with proof of trademark rights to the Anti-Commercial Fraud Department (ACFD).
